§ 5-222. Definitions.

  • As used in this article the following terms shall have the following meanings respectively ascribed to them in this section:

    Boardinghouse/rooming house means a structure that contains dwelling units where the occupants are permanent in nature and are provided with a sleeping room, but not always kitchen provisions. Permanent in nature shall mean thirty (30) days or longer.

    Dwelling means any structure, building or other facility occupied by a residential tenant or tenants for use as a home, residence or sleeping unit. This definition includes, but without limitation, multiple-family dwellings, apartment units, boardinghouses, rooming houses, but does not include hotels and motels or any state licensed assisted living or nursing care facilities.

    Hotel/motel means any building containing guest rooms intended or designed to be used, or that are used, rented or hired out to be occupied, or that are occupied for sleeping purposes and do not include provisions for a kitchen.

    Multi-tenant common area means area common to each group of tenant units, including, but not limited to, mechanical rooms, storage rooms, exit facilities, recreational areas, parking lots, sidewalks and other public spaces within or connected to the building.

    Multi-tenant dwelling means any structure containing two (2) or more tenant units on a single parcel of land, at least one (1) of which is a dwelling that is either occupied or offered for occupancy. This will include mixed use occupancies where dwelling units are combined with commercial space.

    Notice of violation means a notice issued to the owner or responsible local agent stating that there has been a violation of a provision of this article or any other applicable codes, ordinances, rules or regulations concerning said premises.

    Occupancy refers to any tenants, lessees and persons residing within a multi-tenant dwelling or tenant unit.

    Owner means any person, agent, firm, or corporation having a legal or equitable interest in the premises.

    Premises means any lot or piece of land inclusive of the multi-tenant dwelling or tenant unit.

    Tenant unit means any one (1) area, room, structure, flat, apartment, mobile home unit or facility of a dwelling that is being occupied by one (1) tenant, group of tenants or family under one (1) lease.
